These Terms of Use govern the access to and use of the BerlinOne platform, operated by Les Applications B1 inc..

By creating an account or using BerlinOne, you agree to these Terms of Use and our Privacy Policy.

If you do not agree to these terms, you must not use BerlinOne.

1. Description of Service

BerlinOne is a collaborative platform for creating, organizing, exploring, and sharing historical events.

Depending on your subscription plan, BerlinOne may offer the following features, among others:

  • creation of public or private categories;
  • creation, modification, and organization of events;
  • visualization on an interactive timeline;
  • sharing of categories with other users;
  • content generation assisted by artificial intelligence (AI Lab);
  • automatic translation of content;
  • other features that may evolve as the platform is developed.

Certain features are reserved for specific subscription plans.

2. User Account

To use certain features of BerlinOne, you must create an account.

You agree to:

  • provide a valid email address;
  • provide accurate information;
  • protect access to your account;
  • keep your information up to date.

You are responsible for all activity that occurs under your account.

You must be at least thirteen (13) years old or the minimum age required in your jurisdiction.

3. Subscriptions

BerlinOne offers various subscription plans, including a free plan and paid plans.

The features included in each plan are described on BerlinOne and may be modified to evolve the service.

Paid subscriptions are offered in Canadian dollars (CAD) and are managed by a third-party payment provider. BerlinOne is marketed primarily in Canada.

Renewals, cancellations, billing, and applicable taxes are processed in accordance with the terms applicable at the time of your subscription.

4. Acceptable Use

You agree not to use BerlinOne to:

  • violate any applicable law;
  • infringe upon the intellectual property rights of others;
  • publish content that is defamatory, hateful, discriminatory, fraudulent, or demonstrably false with the intent to deceive;
  • harass, threaten, or intimidate other users;
  • attempt to gain unauthorized access to our systems;
  • disrupt the normal operation of the platform;
  • use automated tools without our permission;
  • promote or facilitate illegal activities.

We reserve the right to suspend or delete any content or account that violates these Terms of Use or compromises the proper functioning of BerlinOne.

5. Intellectual Property

All intellectual property rights related to BerlinOne, including but not limited to the software, user interface, design, logos, trademarks, databases, and content produced by Les Applications B1 inc., remain our property or that of our partners.

No ownership rights are transferred to you through your use of BerlinOne.

We grant you a personal, non-exclusive, non-transferable, and revocable license to use BerlinOne in accordance with these Terms of Use.

6. User-Generated Content

You retain ownership of the content you create on BerlinOne.

You represent and warrant that you have the necessary rights to publish the content you add to BerlinOne, or that you are authorized to use it in accordance with its applicable license.

By posting content on BerlinOne, you grant Les Applications B1 inc. a worldwide, non-exclusive, royalty-free license to:

  • host your content;
  • store it;
  • reproduce it;
  • display it;
  • translate it;
  • distribute it as part of the normal operation of BerlinOne.

This license is limited to the operation of BerlinOne and its related services.

Public Content

When you choose to make a category public, you agree that its content may be viewed by all users of BerlinOne.

You also acknowledge that this public content may be used to permanently enrich the collaborative knowledge base of BerlinOne.

Therefore, if you delete your account, public categories and the events they contain may be retained after the complete anonymization of their author.

All data that can identify you will then be deleted in accordance with our Privacy Policy.

Private categories and categories shared with restrictions are deleted when the account is deleted.

7. Artificial Intelligence

BerlinOne may use artificial intelligence services to assist users with content creation, translation, or other features.

Content generated or suggested by artificial intelligence is provided for assistance purposes only.

Image suggestions may come from third-party sources. Although BerlinOne applies selection criteria intended to suggest images whose license is compatible with their reuse, Les Applications B1 inc. cannot guarantee the accuracy of the information associated with these images nor the absence of any error originating from these sources.

The user remains responsible for verifying the accuracy and relevance of the content before its publication.

Les Applications B1 inc. does not guarantee the accuracy or completeness of content generated or suggested by artificial intelligence.

8. Service Availability

BerlinOne is provided "as is" and "as available".

We make reasonable efforts to ensure the availability of the service, but we do not guarantee that it will be free from interruptions, errors, or temporary data loss.

We may temporarily interrupt the service to perform maintenance, updates, or improvements.

9. Limitation of Liability

To the extent permitted by applicable law, Les Applications B1 inc. shall not be liable for:

  • errors in content published by users;
  • content generated or suggested by artificial intelligence;
  • errors or inaccuracies concerning licenses, copyright, or other information from third-party sources used to suggest certain content;
  • the use that third parties may make of public content;
  • data loss resulting from a force majeure event;
  • indirect, special, incidental, or consequential damages arising from the use of BerlinOne.

The total liability of Les Applications B1 inc. shall not exceed the amounts actually paid by the user during the twelve (12) months preceding the dispute.

10. Termination

You may delete your account at any time.

Account deletion is carried out in accordance with our Privacy Policy.

We may suspend or terminate an account, particularly when:

  • these Terms of Use are violated;
  • conduct jeopardizes the security or operation of BerlinOne;
  • we are required to do so by a legal obligation.

The provisions relating to intellectual property, limitations of liability, and public content shall survive the termination of the account.

11. Amendments

We may amend these Terms of Use to reflect changes to BerlinOne or applicable laws.

In the event of a material change, users will be notified through an appropriate channel.

Continued use of BerlinOne after the new terms come into effect constitutes your acceptance of them.

12. Governing Law

These Terms of Use are governed by the laws of the province of Quebec and the applicable federal laws of Canada.

Any dispute shall be submitted to the competent courts of the province of Quebec, unless otherwise required by a mandatory provision of law.
