Terms of Use

These Terms of Use govern access to and use of the BerlinOne platform. BerlinOne is operated by Les Applications B1 inc. (“BerlinOne”, “we”, “us”, or “our”).

By creating an account or using BerlinOne, you accept these Terms of Use and our Privacy Policy.

If you do not accept these terms, do not use BerlinOne.

1. Description of Service

BerlinOne is a collaborative platform for creating, organizing, exploring, and sharing historical events on a timeline.

BerlinOne offers, among others, the following features:

  • creation of public or private categories;
  • creation, editing, import, and export of events;
  • viewing events on an interactive timeline and on a map;
  • sharing private categories with invited people;
  • proposing events in other users' categories;
  • content generation assisted by artificial intelligence (AI Lab);
  • automatic translation and read-aloud of content.

These features may change as the platform develops.

Certain features, as well as the quantities allowed (categories, events, invitations, artificial intelligence credits), depend on your plan.

2. User Account

You must have an account to use BerlinOne. During the alpha phase, an account can only be created by invitation.

You sign in with your Google or Microsoft account, or with a link sent to your email address. BerlinOne does not manage any passwords.

We send you emails related to your account, such as sign-in links and renewal notices. Anniversary notifications are sent only if you turn them on, and each one lets you unsubscribe.

Text message reminders. With the SMS reminders option, you can also receive the anniversary notifications of the categories you follow by text message, in Canada: at most one text message per day, in addition to the verification codes for your number. Message and data rates from your mobile provider may apply. Reply STOP to stop receiving text messages, or HELP for help. Mobile carriers are not liable for delayed or undelivered messages.

You agree to:

  • use a valid email address that you have access to;
  • provide accurate information and keep it up to date;
  • protect access to your email address and to your Google or Microsoft account, which give access to your BerlinOne account.

You are responsible for all activity carried out from your account.

You must be at least fourteen (14) years old, or the higher age required where you live.

3. Subscriptions

BerlinOne offers a free plan and paid plans. The content and price of each plan and each add-on are shown on BerlinOne before you subscribe and may change.

A paid subscription renews automatically, billed monthly or yearly, in Canadian dollars. Yearly billing is paid in a single payment for the yearly period. Add-ons follow the plan's billing cycle and appear on the same invoice. Payments are processed by Stripe. For a yearly subscription, a notice is sent to you about 30 days, then 3 days, before the automatic renewal.

Changing your subscription. A higher plan or an added add-on takes effect immediately; the remainder of the current period is billed on a prorated basis. A lower plan, removing an add-on, or changing the billing cycle takes effect at the next renewal.

Canceling. You can cancel automatic renewal at any time from the My Subscription page. Your subscription and its add-ons stay active until the end of the paid period, then your account returns to the free plan. Subject to applicable law, no credit or refund is given for a period that has begun.

Declined payment. If a payment is declined, your subscription stays active for 7 days, giving you time to update your payment method. If no payment is made by the end of that period, your account returns to the free plan.

Returning to the free plan. Your content is kept: you can continue to view and manage your categories. The free plan's limits apply to what you add afterwards: you cannot create categories or add events beyond that plan's limits, even if your existing content already exceeds them.

4. Acceptable Use

You agree not to use BerlinOne to:

  • break any applicable law;
  • infringe the intellectual property rights of others;
  • publish defamatory, hateful, discriminatory, fraudulent, or deliberately misleading content;
  • harass, threaten, or intimidate other people;
  • attempt to gain unauthorized access to our systems;
  • disrupt the normal operation of the platform;
  • use bots or other automated tools without our permission;
  • promote or facilitate illegal activities.

We reserve the right to remove any content, and to suspend or delete any account, that violates these Terms of Use or that compromises the proper operation of BerlinOne.

5. Intellectual Property

BerlinOne and its elements, including the software, the interface, the design, the logos, the trademarks, the databases, and the content produced by Les Applications B1 inc., belong to Les Applications B1 inc. or its partners.

Using BerlinOne does not transfer to you any ownership right in these elements.

We grant you a personal, non-exclusive, non-transferable, and revocable license to use BerlinOne in accordance with these Terms of Use.

6. User-Generated Content

You remain the owner of the content you create on BerlinOne.

You declare that you hold the necessary rights to the content you add, or that you are authorized to use it under its license.

By adding content to BerlinOne, you grant Les Applications B1 inc. a worldwide, non-exclusive, royalty-free license to:

  • host and store it;
  • reproduce and display it;
  • translate it and read it aloud, including by means of artificial intelligence services;
  • distribute it to the people who have access to it.

This license is limited to the operation of BerlinOne and its related services.

Private categories

A private category is visible only to you and to the people you share it with. Our administrators may access it when necessary for the operation or security of the service.

Public categories and proposals

A public category can be viewed by all BerlinOne users, with your pseudonym as its author. You choose whether it accepts event proposals from other users.

When you propose an event in someone else's category, that person accepts or rejects it. An accepted event becomes part of their category.

Deleting your account

Public content contributes lastingly to BerlinOne's collaborative knowledge base. That is why, if you delete your account:

  • categories you made public and their content are retained;
  • events you added to other users' categories are retained;
  • private categories you own, including those you share, are deleted along with their content.

Retained content is de-identified: the link to your account is removed and the author is replaced with “Inconnu” (“Unknown”). Information you may have entered in titles or descriptions is not removed automatically; the Privacy Policy explains how to request its removal.

We reserve the right to assign a new owner to such de-identified categories at any time.

The license you grant us on retained content continues after your account is deleted.

7. Artificial Intelligence

BerlinOne uses artificial intelligence services to help you create content, to translate content, to read it aloud, and to suggest images and references.

Content generated or proposed by artificial intelligence consists of suggestions. It may contain errors or be incomplete: check it before publishing. You remain responsible for the content you publish.

Suggested images come from third-party sources, such as Wikimedia Commons. BerlinOne verifies their license at the source and shows their author and license, but cannot guarantee the accuracy of the information provided by these sources.

Certain artificial intelligence features, such as the AI Lab, use credits. The number of credits depends on your plan.

8. Service Availability

BerlinOne is provided “as is” and “as available”.

We make reasonable efforts to keep the service available, but we do not guarantee that it will be free of interruptions, errors, or temporary data loss.

We may temporarily interrupt the service for maintenance, updates, or improvements.

9. Limitation of Liability

To the extent permitted by applicable laws, Les Applications B1 inc. cannot be held liable for:

  • errors in content published by users;
  • content generated or proposed by artificial intelligence;
  • errors concerning licenses, copyright, or other information from third-party sources;
  • use that third parties might make of public content;
  • data loss resulting from force majeure;
  • indirect, special, incidental, or consequential damages arising from the use of BerlinOne.

The total liability of Les Applications B1 inc. cannot exceed the amounts you actually paid during the twelve (12) months preceding the dispute.

10. Account Deletion and Suspension

You can delete your account yourself from the Preferences page. If you have an active paid subscription, you must cancel it first.

Deletion is immediate and permanent. Section 6 and the Privacy Policy specify what is deleted and what is retained.

We may suspend or delete an account, in particular when:

  • these Terms of Use are not respected;
  • a behavior compromises the security or operation of BerlinOne;
  • a legal obligation requires us to do so.

The provisions relating to intellectual property, user-generated content, and limitation of liability continue to apply after the account is closed.

11. Amendments

We may amend these Terms of Use to reflect changes to BerlinOne or to applicable laws.

Any significant change will be announced on BerlinOne or communicated by email when appropriate.

If you continue to use BerlinOne after the new terms take effect, you accept them.

12. Governing Law

These Terms of Use are governed by the laws of the Province of Quebec and the applicable federal laws of Canada.

Any dispute will be submitted to the competent courts of the Province of Quebec, unless a mandatory provision provides otherwise.
